1. INTRODUCTION

Premises Management Systems Pvt. Ltd., A.K.A. PMSPL, (“Company”, “we”, “our”, “us”) provides enterprise-grade, white-labelled, single-tenant Software-as-a-Service (SaaS) platforms for workforce management, safety compliance, induction tracking, audit management, and related operational functions. The SaaS platforms are - Construction SafetyApp, ClientCare and HomeWorks.

This Privacy Policy describes how personal data is collected, processed, stored, disclosed, and protected when:

  • You visit our website

  • You request a demo, trial, or subscription

  • You use any PMSPL software product

  • You access a customer-branded (white-labelled) deployment

  • You interact with us for support, marketing, or partnership purposes
     

This Policy applies to:

  • Website visitors

  • Prospective and existing customers

  • Authorized users (administrators, supervisors, managers, etc.)

  • Workers, contractors, staff, and inductees registered by customer organizations

Your use of our Services is also subject to applicable Terms & Conditions.

2. WHITE-LABELLED AND SINGLE-TENANT DEPLOYMENT MODEL

PMSPL provides:

  • White-labelled deployments (branded under the customer’s identity, where applicable)

  • Single-tenant architecture with isolated infrastructure and databases


Accordingly:

  • Each customer operates in a logically segregated environment

  • Customer data is not shared across tenants

  • There is no cross-customer data visibility

  • Data is not pooled for commercial use
     

3. DATA OWNERSHIP

All operational and workforce data entered into the PMSPL platform:

  • Is collected by the respective customer organization

  • Is owned by the respective customer

  • Remains under the control of the customer


PMSPL does not claim ownership over:

  • Worker data

  • Contractor data

  • Staff records

  • Attendance logs

  • Safety and incident reports

  • Compliance documentation

  • Training and certification records

  • Uploaded files or documents

We act strictly as a technology service provider.

4. ROLE UNDER DATA PROTECTION LAW
In accordance with applicable laws, including the Digital Personal Data Protection Act, 2023:

4.1 Customer as Data Fiduciary
For workforce, contractor, and operational data:

  • The customer determines the purpose and means of processing

  • The customer acts as the Data Fiduciary


4.2 PMSPL as Data Processor
PMSPL processes such data:

  • Only under contractual instructions

  • Only for providing SaaS services

  • Without independent commercial exploitation


4.3 PMSPL as Data Fiduciary (Limited Scope)
For website visitors, demo inquiries, marketing subscriptions, and direct communications, PMSPL acts as Data Fiduciary.

5. CUSTOMER RESPONSIBILITY FOR CONSENT AND COMPLIANCE
Customers using PMSPL platforms are responsible for:

  • Obtaining valid consent from workers, contractors, and staff

  • Executing required undertakings or declarations

  • Informing individuals about data usage

  • Ensuring lawful collection of government-issued identification documents, where required

  • Ensuring compliance with applicable labour and data protection laws

  • Ensuring accuracy of data entered into the platform

PMSPL does not independently collect workforce data outside customer-configured workflows.

6. INFORMATION PROCESSED THROUGH THE SAAS PLATFORM
Depending on customer configuration, the platform may process:

  • Name

  • Contact details

  • Photograph

  • Employment or contractor details

  • Site allocation

  • Skill category

  • Induction acknowledgements

  • Training records

  • Attendance logs

  • Incident and safety reports

  • Emergency contact information

  • Location check-in data (if enabled)

  • Government-issued identification details (if required by customer policy)

  • Uploaded compliance documentation

All such data is processed within the customer’s isolated tenant environment.

7. INFORMATION COLLECTED DIRECTLY BY PMSPL
When you interact directly with PMSPL (outside customer deployments), we may collect:

  • Name

  • Email address

  • Phone number

  • Company details

  • Designation

  • Billing information

  • Payment details (processed via secure payment gateway)

  • Device and usage data

  • Cookies and analytics information

Payment information is handled through authorized third-party processors. PMSPL does not store full payment card details.

8. PURPOSE OF PROCESSING
Personal data is processed for:

  • Workforce induction and compliance tracking

  • Attendance and access management

  • Safety monitoring and incident reporting

  • Regulatory compliance

  • Contractual service delivery

  • Subscription management and billing

  • Customer support

  • System security and monitoring

  • Platform maintenance and improvement

  • Legal and regulatory compliance

We do not sell personal data.
We do not monetize customer operational data.

9. DATA SHARING AND DISCLOSURE
We may disclose data only in limited circumstances:

9.1 Service Providers
We engage trusted third-party providers for:

  • Cloud hosting infrastructure

  • SMS and email delivery

  • Payment processing

  • Security monitoring

  • Analytics services

All service providers are contractually bound to maintain confidentiality and data protection standards.

9.2 Legal Requirements
We may disclose data if required by:

  • Applicable law

  • Regulatory authority


9.3 Business Transfers
In the event of merger, acquisition, restructuring, or asset transfer, data may be transferred subject to confidentiality obligations.

10. DATA RETENTION
Customer Data:

  • Retained during the active subscription period

  • Retained in accordance with contractual obligations

  • Returned or deleted upon termination, subject to agreed retention requirements

Website and marketing data:

  • Retained for legitimate business purposes

  • Deleted upon withdrawal of consent where applicable

Encrypted backups may persist temporarily as part of standard disaster recovery procedures.

11. DATA SECURITY
We implement reasonable and industry-standard security measures, including:

  • HTTPS encryption in transit

  • Role-based access control

  • Secure authentication mechanisms

  • Password hashing

  • Firewall protection

  • Server monitoring

  • Activity logging

  • Restricted personnel access

While we follow established security practices, no system can guarantee absolute security.

  • Conduct analytics

13. RIGHTS OF INDIVIDUALS

For workforce-related data, requests should generally be directed to the employer organization (Data Fiduciary).
